OBJECTIVE OF DINDER CLUB:

DINDER CLUB is a dating application aimed at users with a minimum intellectual disability of 33% and aims to connect users based on their preferences, hobbies, and common interests. Through the APP, users can engage in conversations via chat and schedule in-person meetings.

Additionally, the application also offers a wide selection of plans of various types, including training workshops, leisure, cultural, sports, and culinary activities. These plans will be organized and/or promoted by DINDER CLUB and will be published in the APP, where users can access them and obtain all the necessary information for participation and attendance.

If participation and attendance in an event organized or promoted by DINDER CLUB involve expenses for the user, the payment conditions, schedules, travel, and other specific characteristics of the event will be provided in the call to register for the event.

In any case, the services indicate the sale price in Euros (€) and include Value Added Tax (VAT). If any other tax applies, it will be indicated (IGIC or IPSI).

2. DATA PROTECTION POLICY

In accordance with the provisions of the Directive on electronic privacy (Directive 2002/58/EC amended by Directive 2009/136/EC), "End-user terminal equipment and all information stored on such equipment form part of the private sphere of end-users, which must be protected in accordance with the European Convention for the Protection of Human Rights and Fundamental Freedoms."

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, DINDER CLUB informs the User about the platforms that the information collected on the websites will be incorporated into the processing systems under the responsibility of BUBBLEMEETINGS, S.L., for the purposes of managing and maintaining the relationship with the User on the websites, as well as performing information, statistical, and marketing tasks for the services and activities related to them.

Legal basis for processing:

BUBBLEMEETINGS SL informs that the legitimate basis for the processing of personal data is the existence of a legal and/or contractual relationship between both parties and the consent given by the Users.


Data retention:


BUBBLEMEETINGS SL informs that the data will be kept for as long as the consent given by the User persists, except in cases where there is a legal obligation to retain the data and for the duration of the legal and/or contractual relationship.


Rights of the data subjects:

BUBBLEMEETINGS SL informs Users that they may exercise their rights of access, rectification, limitation, deletion, portability, and opposition to the processing of their personal data by the Data Controller, as well as the withdrawal of the consent given.


Access Right:

It is the right of the User to obtain information about their specific personal data and the processing that has been or is being carried out, as well as the available information about the origin of such data and the communications made or planned regarding them.


Right to Rectification:

It is the right of the data subject to have inaccurate or incomplete data modified. It can only be satisfied in relation to information that is under the control of the APP, for example, deleting comments posted on the page, images, or web content that contain the User's


Right to Limitation of Processing: It is the right to limit the original purposes of processing as initially planned by the data controller.


Right to Erasure: It is the right to erase the User's personal data, except as provided in the GDPR or other applicable regulations that determine the mandatory retention of such data, in terms of time and form.


Right to Data Portability: The right to receive personal data provided by the User in a structured, commonly used, and machine-readable format and to transmit it to another controller.


Right to Object: It is the User's right to prevent the processing of their personal data or to stop the processing by the APP.


To exercise any of the rights described above, you must meet the following requirements:

Submission of a written request to the address AVENIDA DIAGONAL 177, 08018 BARCELONA (BARCELONA) (Attention: BUBBLEMEETINGS SL) or by email to administracio@bubblemeetings.com. The written request from the data subject must meet the following legal requirements:

  • Full name of the interested party and a copy of ID/NIE or any identification document. In exceptional cases where representation is admitted, identification by the same means of the person represented is also necessary, as well as the document accrediting the representation. A photocopy of the ID can be replaced, provided that identity is proven by any other valid means in law.
  • Specific request detailing the information sought. (Exercise in which the information to be accessed is requested). If it does not refer to a specific file, all information with personal data will be provided. If information from a specific file is requested, only information from that file will be provided. Information regarding a third party will never be provided. If requested by phone, you will be instructed to do so in writing and will be informed of how to do it and the address to which it should be sent. No information will be given over the phone.
  • Address for notification purposes.
  • Date and signature of the applicant.
  • Supporting documents for the request.

The interested party must use any means that allows proof of the sending and receipt of the request.

Finally, we inform you that you have the right to file a complaint with the Spanish Data Protection Agency if you become aware or believe that an event may constitute a breach of the applicable data protection regulations.

BUBBLEMEETINGS SL undertakes to adopt the technical and organizational measures necessary, according to the level of risks associated with the processing carried out by them and indicated in the terms and conditions of use section, to guarantee their integrity, confidentiality, and availability.


a) Accuracy and timeliness of data

DINDER CLUB informs Users that the Platform may contain links to other websites unrelated to DINDER CLUB, so it will not be responsible for the processing of personal data that the User provides on those websites. Consequently, we recommend that you review the privacy policies of such sites.

Likewise, DINDER CLUB informs that if the User enters data in the forms of third-party websites, these will be responsible for the personal data, and they must take the technical measures described in the section of these Terms and Conditions of Use.

Management of legal/tutor caregivers data

Purpose: Management of the data of the legal guardians of those Users who have designated one.

Retention Period: As long as the consent given lasts

Legal Basis: Consent of the legal guardian.

Compliance management

Purpose: Management and processing of the obligations and duties arising from compliance with the regulations to which the entity is subject

Retention Period: Conservation of copies of documents until the actions to claim possible responsibility prescribe

Assignments: Your data will be communicated if necessary to Bodies and/or public administration with competence in the matter in order to comply with the obligations established in the applicable regulations. Payment management

Purpose: Administrative management, billing, accounting, and legal obligations.

Retention Period: 5 years in compliance with tax law and 10 years for fiscal documentation in compliance with L.O. 7/2012

User Profiles Elaboration

Purpose: DINDER CLUB will carry out profile elaborations through automated processing of data provided by Users in order to assess and analyze which profiles within the APP are more compatible with each other. Through automated processing of the data that the interested party provides when registering as a User and completing their profile, this information will be used to make it easier for Users to connect with members who have reported similar tastes, preferences, and/or hobbies.

Retention Period: As long as the provided consent persists and for no longer than necessary in proportion to the purposes of the processing of personal data.

Legal Basis: The decision to carry out profile elaborations is necessary for the APP to make connections between users who are more compatible with each other.

Data Types: Users are informed that, for the elaboration of profiles, merely identifying personal data and special category data will be processed.

In relation to merely identifying data, the following will be used: name and surnames, age, image, the educational center to which the User belongs, and academic data.

For the elaboration of profiles, the information that the User has provided and completed in their profile account will also be used, such as chosen hobbies and interests.

The special category data that will be processed for the elaboration of profiles are:

  • Health
  • Gender identity
  • Sexual orientation

For the elaboration of profiles, the following logic will be applied: Through the registration as a user, and once the profile of each User is completed according to hobbies, preferences, intellectual disability type, etc., an automated system will be used to connect APP members with more compatibility.

This can lead to the following consequences: The processing of the aforementioned personal data in an automated manner has the effect of an automatic decision for the interested party/User.

In this regard, it should be noted that as an interested party, the User has the right to ensure human intervention in the process of making such automated decisions.

Image Treatment

Purpose: Capture, recording, and processing of images captured through photographs and/or videos taken by DINDER CLUB, with the aim of enhancing the corporate image and/or promoting the activities of the organization and publishing them on the website and/or social media of the organization.

Retention Period: As long as the consent of the interested party persists, unless there is a legal obligation to retain the data.

Legal Basis: The consent of the interested party.

3. Privacy policy security

BUBBLEMEETINGS SL is committed to complying with the Terms and Conditions of Use and the Privacy Policy regarding the APP and the Services, as outlined in the following sections:


a) Geolocation

DINDER CLUB requires access to the device's geolocation, and users must use the operating system's location services. This access is considered the collection of personal data, so it is necessary to transmit geolocation data to the APP.

Before and after installation, information regarding the use of the location system will be provided, and users must explicitly accept or reject it. At any time, users can easily and effectively revoke the treatment performed by the APP using the device's location, thereby preventing the APP from accessing location data.

Uninstalling the APP not only removes the application but also disables the use of device location for the APP. The APP can only access geolocation data when the user is actively using the application, and it is not continuously activated. If continuous use of location data is required, precise and prior information will be provided, requesting express consent independently. For more information on disabling this function, you can refer to the following links: iOS and Android. Disabling this functionality may affect the optimal functioning of the APP.


b) Applications Used by DINDER CLUB

Device Permissions

Most mobile platforms (iOS, Android, etc.) define certain types of device data that the APP cannot access without user consent. These platforms have different authorization systems to obtain consent. The iOS platform will notify you the first time the APP requests permission to access certain types of data, allowing you to grant or deny consent to this request. Android devices will notify you of the permissions the APP requires before you use it for the first time, and your usage will constitute your consent.

DINDER CLUB may use the functions of applications available on the device itself, thereby accessing stored data. In any case, the APP will inform you about the use of these applications, request your consent, and provide clear and complete information beforehand. It will also offer users the option to express their willingness to accept or reject the use of specific data that the APP requires for installation.

BUBBLEMEETINGS SL informs users that non-acceptance of different applications on their mobile device may result in the APP not functioning in its entirety, with certain sections not being enabled for the user. c) Permitted Uses and Restrictions

Users residing or domiciled in countries within or outside the European Union must ensure that access to and use of the Application and/or its content is permitted in accordance with their own legislation. In any case, access and use of the Application by a user who does not meet the residency requirement in Spain will be considered their sole responsibility, relieving BUBBLEMEETINGS SL of any liability.

DINDER CLUB informs that it does not process the data of minors. If a parent and/or guardian detects that their child has provided personal data fraudulently or inaccurately without their consent, they should contact us at administracio@bubblemeetings.com. BUBBLEMEETINGS SL will proceed to delete the personal data, as well as any information provided by the minor, from our database.

d) Push Notifications

This APP may send push notifications to the User to achieve the objectives described in this Privacy Policy and Terms and Conditions of Use. In most cases, users can disable the receipt of push notifications by entering their device settings, such as notification settings for mobile phones, and then changing the settings for this Application, some, or all applications on that specific device. Users should be aware that disabling push notifications may negatively impact the utility of this Application.


e) Device Information

For the proper functionality of DINDER CLUB, there is a possibility that it can access the following information:

Device Attributes: Information such as the operating system, hardware and software versions, battery charge level, signal strength, available storage space, browser type, types and names of APPs and files, and plugins.

Identifiers: Unique identifiers, device identifiers, and other identifiers, such as those from games, APPs, or accounts you use, as well as familiar device identifiers.

Device Signals: Bluetooth signals and information about nearby wifi access points, beacons, and cellular towers.

Device Configuration Data: Information that allows the user to receive through the settings activated on their device, such as GPS location access, camera, or photos.

Network and Connections: Information such as the name of the phone operator or internet provider, language, time zone, phone number, IP address, connection speed, and, in some cases, information about other devices nearby or on your network, so that we can do things like help you stream a video from your phone to the TV.

TERMS AND CONDITIONS OF USE

1. User interaction


DINDER CLUB allows the User, through the application provided by it:

1.1 The User acknowledges and accepts that

a)this APP grants a non-exclusive, limited, non-transferable, and revocable license for the use of the service. The User must use it exclusively for personal, non-commercial, or entertainment purposes. DINDER CLUB reserves all rights not expressly granted in the service or its Terms and Conditions of Use. DINDER CLUB may terminate this license at any time and without cause.

b) DINDER CLUB is not responsible for the content of any third-party advertisements or the content of any websites or other materials that may be linked to third-party advertising. The User is responsible for viewing them.


1.2 User Obligations

The User can only use the APP and/or the Services if the following requirements are met:

  • Access to DINDER CLUB and/or the Services may require the device to be connected to the Internet or need other third-party services.
  • The User must comply with the terms of the third party when using the Services.
  • The User is responsible for ensuring that the installation and use of the APP do not exceed data usage quotas or other limitations that may apply to their Internet service or other services purchased from third parties.


1.3 The User agrees not to:

  • Use or promote the use of any cheats, modifications, exploits, or other unauthorized means to interfere with, or gain an unfair advantage in using the APP and/or the Services.
  • Attempt to disrupt the normal operation of the APP or any other infrastructure operated by DINDER CLUB.
  • Attempt to gain unauthorized access to the APP.
  • Make any automated use of the APP.
  • Impersonate another person in using the APP, or
  • Use the APP in connection with the violation or attempt of any applicable law.

2. Operation

2.1 Scope of Application

DINDER CLUB is available for download in Spain and any enabled country.

2.2 Obtaining DINDER CLUB through Digital Stores

2.2.1 Digital Stores

If the APP is obtained through any digital store, the User and DINDER CLUB recognize and accept that:

  • This document is entered into between the User and DINDER CLUB only, and not with the digital stores. The company is solely responsible for the APP and its content.
  • Digital stores have no obligation to provide maintenance and support services in relation to the APP, whether under these terms and conditions or other applicable law.
  • DINDER CLUB, and not digital stores, will handle User or third-party claims regarding the APP, including:Claims of responsibilities for services offered in the APP.
  • Any claim in case the APP does not comply with any applicable legal or regulatory requirement.
  • Claims related to consumer protection or similar legislation.
  • In the event of any third-party claims regarding the infringement of intellectual property rights in relation to the APP or its possession or use, DINDER CLUB, and not digital stores, will be solely responsible for the investigation, defense, and processing of such claims.
  • Digital stores and/or their affiliates will be third-party beneficiaries of this document.
  • Upon acceptance of this document, digital stores will have the right to enforce it as a third-party beneficiary.

2.2.2 Downloading DINDER CLUB

DINDER CLUB is a cross-platform application available on the Apple Store and Play Store. This allows managing communications independently of the device from which it is accessed.

Unique credentials are used.


2.3 Cost of the APP

Downloading the APP does not incur any cost for the User.


2.4 Payment Methods

The download of the APP does not involve payments, so no data related to the User's payment methods will be requested.


2.5 Uninstallation

If the User wishes to uninstall the APP, they must proceed with the uninstallation on their device. This action does not imply the automatic deletion of the information that the APP has about the User. If the User wants the information available from BUBBLEMEETINGS SL to be deleted, they must formalize their request through an email to administracio@bubblemeetings.com or to the address AVENIDA DIAGONAL 177, 08018 BARCELONA (BARCELONA).


2.6 User Account Cancellation

If the User decides to cancel their profile account, they can go to its settings and unsubscribe. When the User unsubscribes their profile, it will no longer be visible to other Users using the APP.

Once the User requests the cancellation of their profile, DINDER CLUB will block all personal data related to the User, as well as their account, and restrict access, making them not visible to other members using the APP. After the legally established period for data retention by legal obligation, they will be permanently deleted from our platform.

However, User data may be kept in the following cases: due to a legal obligation, to meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our terms of use, or fulfill your request for cancellation to avoid receiving future messages from us. Once the account is closed, the information will be kept in an anonymized manner. In case of any additional doubts, you can contact us through the email administracio@bubblemeetings.com.

3. Support

In accordance with these Terms and Conditions of Use, DINDER CLUB will be obliged to offer and/or publish new extensions or versions and other services related to the use of the APP or the Service.


In any case, it is the responsibility of BUBBLEMEETINGS SL to update the APP, using the functionalities provided by DINDER CLUB through the digital store.


The User may be informed through push notifications about the updates that need to be made to the APP.

4. Third-Party services

DINDER CLUB may use third-party services:


a) To obtain software and/or services (e.g., for the creation of a specific component of the APP).

b) In connection with the Software and/or services (e.g., a social media website).


In addition, to obtain, install, update, access, use, or continue accessing, you may need to use certain third-party services.


DINDER CLUB may obtain analytics data through providers that allow understanding the usage and analyzing the popularity index of the APP. This analysis is carried out on behalf of DINDER CLUB, so the responsibility for this activity corresponds to the APP itself. In section "7. COOKIE POLICY," the User has complete information about the analysis and the provider(s) used by the APP.


The APP may contain links (including through advertising) to third-party websites or other third-party content or services. These links are provided solely for your convenience and may not be kept up to date or updated. You acknowledge that such links should not be interpreted as an endorsement, approval, or recommendation by us of the third parties, or of any content or services provided by them, and that the use of any third-party content or services may be subject to terms and conditions unrelated to the APP.

5. Warranty


The User acknowledges that it cannot be guaranteed that the APP and the services derived from it are free of errors; the existence of such errors does not constitute a breach of this document.

Unless expressly stated otherwise in this document, and to the extent permitted by applicable law, DINDER CLUB shall not be liable to the User for any loss, including special, indirect, or consequential damages (such as loss of profits), or the claim that arises from the breach of this document or as a result of the defective use of the services offered by BUBBLEMEETINGS SL.

6. USER PROFILES


BUBBLEMETINGS SL informs Users about the profile(s) enabled in the APP, as well as the necessary information for each profile and any information of special categories, if required.


Data Types

6.1 User Registration

To use the functionalities of DINDER CLUB, it is necessary to register as a User in our APP and access the private area. To unregister, see section "5.4 Uninstallation" and "5.5 User Account Cancellation."

The APP may modify the profile settings created within the private area.

When registering, the User must create a username and password to access the APP's features and the private area.

The APP has a password restoration system through:

  • From the APP itself
  • Via email

IMAGE

When creating a user profile, you can customize it by using a photo with the user's consent. The user can modify this image at any time, always complying with section "11. CODE OF CONDUCT" of these Terms and Conditions of Use.

The Organic Law 1/1982, of May 5, on civil protection of the right to honor, personal and family intimacy, and one's own image establishes that this right will be civilly protected against any kind of illegitimate intrusion, including "the capture, reproduction, or publication by photography, film, or any other means, of the image of a person in places or moments of their private life or outside them." Users are informed that the content that may be published in the APP will be protected by intellectual property rights, such as photographs and videos; you grant us a non-exclusive, transferable, sublicensable, royalty-free, globally applicable license to use any content you post in the APP. This license ends when you delete your User profile within the APP, unless the content has been shared with third parties, and they have not deleted it.

DINDER CLUB is not responsible, in any case, for the content of the images or their accuracy.

When a user uploads their profile picture, the image will be manually verified before being visible to other users. This verification process is necessary to ensure that the photograph complies with DINDER CLUB's standards and community rules.

Manual verification means that DINDER CLUB will examine the profile picture to ensure it meets appropriate visibility standards. If the photo does not meet these requirements, it will not be displayed to other users, and the user will be notified so they can provide an alternative photo.

The privacy and security of user data are a priority for DINDER CLUB, so appropriate measures will be taken to protect the profile picture during the manual verification process.

VISIBLE

User profiles may be visible to other users. The information that other users could view includes the profile picture, name, and/or surname, always considering the configuration that the user has set in their profile.

6.2 User Account Security

The User is responsible for maintaining the confidentiality of their username and password designated during the registration process and is solely responsible for all activities carried out under their username and password.

The User understands and agrees to immediately notify the APP of any unauthorized use of their username or password or any other security breach they become aware of, by email: administracio@bubblemeetings.com.

To protect the integrity and security of the Service, BUBBLEMEETINGS SL reserves the right, at any time, at its full availability, to block certain IP addresses of Users from accessing the Service.

7. Cookie policy

A Cookie is a file that is downloaded to your device when accessing certain websites. Cookies allow an APP, among other things, to store and retrieve information about a User's or their device's browsing habits, and depending on the information it contains and how the device is used, it can be used to recognize the User.


In accordance with Article 22.2 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE), which requires informing users about the use of data storage and retrieval devices on terminal equipment, DINDER CLUB informs that when accessing this APP, no cookies will be installed on your devices. In case DINDER CLUB decides to use such devices, it will proceed to inform its users.

8. Code of conduct

Users must comply with all applicable laws and use the available spaces in the APP to leave comments in a correct manner, respecting the code of conduct established in this section, and taking into account the responsibility that may arise from the improper or unlawful use of these spaces.

DINDER CLUB informs about behaviors it does not consider appropriate and the authority it has to act accordingly regarding the following uses, actions, omissions, or statements made by the member in connection with their relationship with DINDER CLUB:

  • Act dishonestly or unprofessionally.
  • Post inappropriate or inaccurate content.
  • Harass, abuse, threaten, or harm another person or User - a member of DINDER CLUB.
  • Use or post images, videos, or any comments on the profile that may offend the sensitivity of Users, as well as discriminate based on any condition, race, ethnic group, nationality, religion, gender, sexual orientation, disability, or illness, or that are illegal, defamatory, abusive, obscene, discriminatory, or for other reasons considered reprehensible.
  • Use another person's account or create a false identity on DINDER CLUB.
  • Make false statements that impersonate someone else.
  • Include content containing computer viruses or others that can delete, interrupt, or hinder proper navigation.
  • Sell, sponsor, or obtain economic benefit through DINDER CLUB without the authorization of BUBBLEMEETINGS SL or if another method provided by BUBBLEMEETINGS SL for the management of an exclusive service has been established.
  • Share information about people who are not Users without their express consent.
  • Create fake profiles in the application; if DINDER CLUB detects fake profiles, they will be immediately deleted.
  • Promote racism, xenophobia, or any form of fanaticism against any group or individual.
  • Imitate or impersonate any person or entity.
  • Solicit money from other Users.
  • Send videos, audios, or photographs with images of another person without their authorization (or, in the case of a minor, without the authorization of their parents or legal guardians).

9. Intellectual property (COPYRIGHT)

Access to the APP does not grant the User any legitimacy or ownership of the intellectual and industrial property rights of the corporate elements.

The texts, images, logos, distinctive signs, sounds, animations, videos, source code, and other content in the APP are the property of BUBBLEMEETINGS SL. DINDER CLUB has the right to use and exploit said APP and content, and in this sense, they are constituted as works protected by current intellectual and industrial property legislation.

The User acknowledges that the materials provided within the Services are protected by copyright and may also be protected as other intellectual property licenses owned by BUBBLEMEETINGS SL.

In the event of a court resolution, the User must indemnify BUBBLEMEETINGS SL against all liabilities, costs, losses, claims, and expenses that BUBBLEMEETINGS SL may incur with a third party as a result of a breach of any of the provisions of this document.

To preserve possible intellectual or industrial property rights, in the event that any User or third party considers that a violation of their legitimate rights has occurred due to the introduction of certain content in the APP, they must notify this circumstance to BUBBLEMEETINGS SL., by email to the address: administracio@bubblemeetings.com, indicating:

  • Personal data of the interested party holder of the rights allegedly infringed. If the claim is made by a third party other than the interested party, they must indicate the representation with which they are acting.
  • Indication of the contents protected by intellectual or industrial property rights, and their location on the website.
  • Accreditation of said intellectual or industrial property rights.
  • Express declaration in which the interested party assumes responsibility for the truthfulness of the information provided in the notification.

The legitimacy of the intellectual or industrial property rights corresponding to the contents provided by third parties is the exclusive responsibility of the third parties themselves.

10. Updates and modifications

DINDER CLUB reserves the right to modify, revise, or replace the Privacy Policy as well as the Terms and Conditions of Use when deemed necessary. Modifications, revisions, and replacements will take effect immediately after their publication. The continued use of the APP or Services after such notification constitutes your agreement to be bound by the terms of this modified, revised, or replaced document, as well as your understanding and acceptance.


The waiver by any party of the exercise of a defense right for any violation or breach by any other party will be effective only when made in writing and signed by the waiving party. Such waiver shall not constitute a waiver of exercising any other right arising from other breaches of this document.


If any provision of this document is declared null in any jurisdiction, that provision of the corresponding jurisdiction will apply so that the provision declared null is ineffective to the extent of the prohibition, invalidity, or inapplicability, without invalidating the remaining provisions of this document or affecting the validity or applicability of such provision in any other jurisdiction.


DINDER CLUB cannot assign, novate, or transfer any of its rights or obligations under this document at its sole discretion without prior notice.


Notwithstanding the foregoing in this document, DINDER CLUB shall not be liable for any delay or failure of its obligations under this document if the delay or failure is due to force majeure, including business disputes.

11. Arbitration and applicable law

You understand and agree that any disputes or claims arising as a result of or related to this End User License Agreement (including any alleged breach thereof), or the Service, shall be exclusively submitted to the Arbitration Court of Madrid, Spain, and shall be resolved through mandatory arbitration.
